TINJAUAN YURIDIS PENYERTAAN (Deelneming) DALAM TINDAK PIDANA ILLEGAL MINING DI WILAYAH HUKUM KEPOLISIAN SEKTOR HULU KUANTAN
Abstract
Bumi Indonesia is an earth that has a lot of natural wealth buried in it, both renewable and non-renewable natural resources. One type of non-renewable natural wealth is natural resources of mining materials, the minerals include gold, silver, coal, copper, nickel, bauxite, petroleum and natural gas. In accordance with Article 33 paragraph 1 to paragraph 3 of the 1945 Constitution, all of these are controlled by the state and used for the greatest prosperity of the people. State control rights contain the authority to regulate, administer and supervise the management or exploitation of minerals, then contain the obligation to use them as much as possible for the prosperity of the people. In controlling the country, it is certainly controlled by the government.
