Efektivitas Penegakan Hukum Terhadap Pertambangan Emas Tanpa Izin (PETI) Di Kabupaten Kuantan Singingi: Analisis Yuridis Atas Kesenjangan Antara Regulasi dan Implementasi
Abstract
Pertambangan Emas Tanpa Izin (PETI) masih menjadi permasalahan yang berkelanjutan di Kabupaten Kuantan Singingi meskipun berbagai regulasi telah mengatur larangan dan sanksi tegas terhadap aktivitas tersebut. Kondisi ini menunjukkan adanya kesenjangan antara norma hukum (law in books) dan implementasi penegakan hukum (law in action). Penelitian ini bertujuan untuk menganalisis efektivitas penegakan hukum terhadap PETI serta mengidentifikasi faktor-faktor yang memengaruhi belum optimalnya implementasi hukum di lapangan. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan studi kepustakaan (library research), melalui analisis terhadap peraturan perundang-undangan, buku, artikel ilmiah, hasil penelitian terdahulu, dan dokumen resmi terkait pertambangan. Analisis data menggunakan Teori Efektivitas Hukum Soerjono Soekanto yang mencakup lima faktor, yaitu substansi hukum, aparat penegak hukum, sarana dan prasarana, masyarakat, serta budaya hukum. Hasil penelitian menunjukkan bahwa penegakan hukum PETI belum berjalan efektif. Meskipun regulasi telah memadai, implementasinya menghadapi hambatan seperti lemahnya pengawasan, koordinasi antarinstansi yang kurang optimal, keterbatasan fasilitas, tingginya ketergantungan ekonomi masyarakat, dan rendahnya kesadaran hukum. Oleh karena itu, diperlukan penguatan koordinasi, peningkatan kapasitas aparat, optimalisasi pengawasan, serta pemberdayaan ekonomi masyarakat untuk mewujudkan penegakan hukum yang efektif, berkeadilan, dan berkelanjutan di Kabupaten Kuantan Singingi.
