Abstract

One manifestation of the Archipelago's Insight that is absolute and non-negotiable is its presence in the strait setting and observation used for international lessons in Indonesian waters. With the passage of the 1982 Law of the Sea Law, the strait regulation and observation efforts have had a legal basis. Through these juridical aspects it is a tool that can be used by our country to maintain its survival. Based on this, the following issues are taken, What is the understanding of the free sea exclusive economic zone in free trade ?. In general, archipelagic countries are relatively more profitable than countries that are close to large areas of land, because: In general they have the potential for international trade, can be more politically able to play their role in the world arena, more secure and protected from invational attacks by countries continental. Therefore conventions arise without setting a means by which a limitation can be achieved. The Convention only points out that 'the solution must be equitable', however the provisions are accepted. The formula only emphasizes the results that must be achieved, but not the methods that must be used to achieve these results. Indonesia as one of the Strait States to make laws and regulations regarding crossing through the Strait, in this case the Strait State must not discriminate in any form among foreign ships so as to inhibit the elimination or reduction of the right of passage. The strait is open and used for international service, open to the cross of peace. What is meant by (peaceful) traffic is shipping for peaceful purposes that crosses the territorial sea and inland waters of Indonesia from the free sea to an Indonesian port and vice versa from the free sea to the free sea.
