PERAN JAKSA DALAM MENERAPKAN KONSEP DIVERSI TERHADAP ANAK YANG BERKONFLIK DENGAN HUKUM DI KEJAKSAAN NEGERI KUANTAN SINGINGI

Abstract

This research is aimed at knowing the implementation of diversion concept towards thechildren who have conflicted with the law at DistrictAttorney'sOfficeofKuantanSingingi in order to know the inhibiting factors for the attorney in using the diversion concept. This research used normative juridical approach that is supported by field research which has been done through the interview with the informants. The data analysis used in this research was qualitative method by collecting primer and secondary data. The research questions proposed are: 1. how is the implementation of diversion concept towards the children who have conflicted with the law at District Court of KuantanSingingi?  . 2. What are the inhibiting factors in settling down the case of conflicted children by using diversion concept at DistrictAttorney'sOffice of KuantanSingingi? Based on the result and analysis of this research, it can be concluded that the implementation of diversion concept at DistrictAttorney'sOfficeofKuantanSingingi has not been working yet since the case of conflicted children is only handled by the police because the criminal prosecution for this case isforanaverageofmorethan7yearswhilethecasesthatrecoveritunder7yearsarefinishedatthepolice office. Meanwhile, the inhibiting factors for the implementation of diversion concept at District Court of KuantanSingingi are: 1. The understanding about diversion definition, 2) the readiness fromthepersoninvolved in implementing diversion concept.
