Abstract

Rules regarding firearms are generally regulated in the Emergency Law of the Republic of Indonesia Number 12 of 1951 Article 1 paragraph (1) which reads: "Whoever, without the right to enter into Indonesia, makes, receives, tries to obtain, surrenders or tries to hand over, control, carry, have inventory with him or have in his possession, store, transport, conceal, use or issue from Indonesia any firearms, ammunition or explosives, sentenced to death or life imprisonment or a maximum prison sentence of two twenty years ''. This research was conducted in the jurisdiction of the Hulu Kuantan Sector Police regarding law enforcement against non-criminal perpetrators of misuse of firearms. The method used in this research is sociological (empirical). The data used are primary data and secondary data. Primary data obtained from field studies, namely the results of interviews with respondents While secondary data obtained from literature studies consisting of primary legal materials, secondary legal materials and tertiary legal materials.The results of research on law enforcement against the perpetrators of criminal acts of misuse of firearms in the jurisdiction of the Hulu Kuantan Upper Police Sector are repressive measures, (such as Investigations, Investigations, Arrests, and Detention). Factors causing the occurrence of criminal acts of misuse of firearms are the lack of supervision by the Police related to the distribution of illegal firearms, the difficulty of procedures for possession of licensed / legal firearms. And the inhibiting factors of law enforcement in handling cases of criminal acts of misuse of firearms are, the limited number of Police personnel who conduct surveillance on the misuse of firearms, the need for police budget funds that are not in accordance with standards, and the lack of transportation facilities and facilities in the Hulu Kuantan Upstream Sector Police.
