Abstract

Islamic law can be understood as a law that comes from the teachings of Islamic law, namely the Koran and the Sunnah. In simple terms, law can be understood as a set of rules or norms that regulate human behavior in a society, whether the rules or norms are in the form of a fact that grows and develops in society or a provision set by the authorities. The form can be written like statutory regulations or unwritten such as customary law. The National Law System that applies in Indonesia, is the National Law System based on Pancasila and the 1945 Constitution, so any areas of law that will be part of the National Law System must be sourced from Pancasila and the 1945 Constitution. The existence of Islamic law in the system Indonesia's national law has become evident with the issuance of Law no. 1 of 1974 concerning marriage and Law no. 7 of 1989 concerning religious courts.
