Abstract

Sustainable forest development requires serious efforts because various forestry crimes still occur, such as illegal logging, mining without permits and plantations without permits. The results of the study concluded that the modus operandi used by the perpetrator to carry out criminal acts of plantation activities in the forest area, namely the perpetrator buying the oil palm plantation from Mr. Idas with an oil palm plantation area of ​​approximately ± 3 (three) Ha which is a forest area of ​​PT. RAPP Estate logas. Then the perpetrator carried out forest encroachment in the form of acacia trees and rubber trees that had been felled and cut into pieces, which the perpetrators replaced by planting oil palm and turning the land into plantation land. Law enforcement of the criminal act of carrying out plantation activities without the minister's permission has been running properly. In the context of law enforcement, in general the handling procedure is the same as in other general criminal cases. The actions taken by the Criminal Investigation Unit of the Kuansing Police in eradicating criminal acts of carrying out plantation activities without the minister's permission are in the form of: repressive actions (crackdown) The repressive actions that are taken are investigation, arrest, detention, search and confiscation. However, in reality until now there are still plantation activities without the minister's permission in industrial forest areas.
