TINJAUAN YURIDIS TERHADAP TINDAK PIDANA PERSETUBUHAN YANG DILAKUKAN TERHADAP ANAK DI WILAYAH POLRES KUANTAN SINGINGI

Abstract

A criminal act is an act or act committed by a human being which is prohibited by the Criminal Law Act. One of the crimes that often occur in Indonesia is the crime of sexual intercourse against children. Sexual intercourse can occur in adults, but can also occur in minors. The selection of children as victims of sexual intercourse can be caused because children are easy to be seduced and persuaded by the lure of certain things. This is why children are often victims of adultery. In general, the problem of sexual intercourse with children occurs because of the main factors, including the lack of supervision from parents. The problem in this research is how the modus operandi of the crime of sexual intercourse against children is in the jurisdiction of the Kuantan Singingi Resort Police, and what are the factors that cause the crime of sexual intercourse against children in the jurisdiction of the Kuantan Singingi Resort Police. For this writing, the writer uses empirical sociological legal research method by means of a survey, while the nature of the research is descriptive with sampling technique using population and sample using purposive sampling method. With data collection tools in the form of interviews and literature studies. Based on the results of the study, it can be concluded that the modus operandi in the crime of sexual intercourse against children in the jurisdiction of the Kuantan Singingi Resort Police is intentionally having sex with persuasion, deceit and a series of other lies on the basis of proving love, forcing it with various threats of violence and intentionally having intercourse because there is an opportunity. Factors causing the occurrence of the crime of sexual intercourse against children in the jurisdiction of the Kuantan Singingi Resort Police, namely the influence of cultural developments that increasingly do not respect the ethics of dressing that cover the genitals which can stimulate other parties to act indecently, lack of supervision from the closest people, especially parents, Relationships among men and women who are increasingly free and have almost no boundaries, Low experience and appreciation of religious norms in society, Religious values ​ ​ that are increasingly eroding have the potential to encourage someone to do evil and harm others. Even more saddened is that the perpetrator committed the crime of sexual intercourse against a child on purpose, precisely to take revenge because the attitude of the victim made the perpetrator offended and hurt.
