Abstract

This study aims to find out how the practice of buying and selling fruits on trees in Bandar Alai Kari Village and how to review muamalah fiqh about the practice of buying and selling fruits on trees in Bandar Alai Kari Village. This research was conducted with interviews with the people of Bandar Alai Kari Village as many as 5 sellers and 3 buyers. Data collection techniques used are observation, interviews and documentation. And analyzed descriptively qualitatively. From the results of the research on the Practice of Selling and Buying Fruits in Bandar Alai Kari Village, where traders or buyers see directly the fruits that are still pistils to be picked when they are old or ripe. And if there is a sale and purchase contract, all the fruits on the tree are fully owned by the buyer. Fiqh Muamalah's review of the practice of buying and selling fruits on this tree is that it is not fully in accordance with the pillars and terms of sale and purchase. In the implementation of taking the goods there are irregularities, and that will make the sale and purchase invalid. Because the quality and quantity of the goods are different at the time of purchase. So it is said that the sale and purchase of fruit on trees in Bandar Alai Kari Village is illegal.
