PERANAN NAZHIR DALAM MENGELOLA DAN MENGEMBANGAKAN TANAH WAKAF PADA YAYASAN WAKAF SYAFA’ATURRASUL MADANI PONDOK PESANTREN SYAFA’ATURRASUL 2 PUTRA
Abstract
This research is motivated by the importance of Nazhir's Role of Managing and Developing Waqf Land. The foundation waqf syafa’aturrasul madani is a nazhir who is responsible for managing and developing waqf land of 20,000 m2 which is intended for the development of the Syafa'aturrasul Islamic boarding school 2 of male jalur patah, Sentajo Raya has been operating since 2019 but has not yet been registered in KUA sentajo raya as waqf land that has AIW or waqf pledge deed as set forth in UU 41 of 2004 concerning waqf.
This reseaech aims to explain how the implementation of waqf land in Syafa'aturrasul Islamic boarding school 2 of male and How is the management and development of waqf land in Syafa'aturrasul Islamic boarding school 2 of male. Then the research is qualitative desriptive research, using two data sources, namely primary data and secondary data. Data collection is done with observation techniques, interviews, and documentation.
The results of this research found that the implementation of land waqf by wakif to the foundation waqf syafa’aturrasul madani has not been implemented based on UU 41 of 2004 Article 16 paragraph 2 about land waqf procedures and Government Regulation of the Republic of Indonesia Number 42 of 2006 article 34 so that the waqf land has not been registered at KUA Sentajo Raya in the form of akta ikrar wakaf (AIW) as waqf land. As for managing and developing waqf land, the syafa'aturrasul madani waqf foundation has managed 60% of the waqf land according to its designation into: gates, security posts, mosques, school offices, and 8 study rooms, but has not managed it productively.
