ANALISIS FAKTOR-FAKTOR PENGHAMBAT PEMBUATAN AKTA IKRAR WAKAF DI KANTOR URUSAN AGAMA KECAMATAN KUANTAN MUDIK

Abstract

This research is motivated by the number of waqf assets that are not registered and have no legality. The Deed of Waqf Pledge is proof of the statement of the will of the wakif to endow his property to be managed by Nazhir in accordance with the designation of the waqf property which is poured in the form of a deed. This study aims to find out how the process of making the waqf pledge deed at the Office of Religious Affairs, Kuantan Mudik District, then the researcher analyzes the inhibiting factors for making a waqf the pledge deed at the religious affairs office in the Kuantan Mudik sub-district. This research method is descriptive qualitative research. Data collection techniques used consisted of observation, interviews, and documentation. The informants in this study were 3 people, employees of the religious affairs office in the Kuantan mudik sub-district.

The results of this study are the process of making the waqf pledge deed (AIW) starting from the requirements that must be complete and submitted by the wakif to the District Religious Affairs Office, then the Head of the Religious Affairs Official as by the Waqf Ikra Deed Maker Official,Then for the factors that hinder the act Waqf pledge deed, the existence of wakif who have not completed the requirements for the implementation of the waqf pledge deed, lackof knowledge of wakif about the waqf pledge deed, there are still many waqf assets that are not registered and the average waqf propertydoes not have legality.
