TINJAUAN YURIDIS PENEGAKAN HUKUM TERHADAP PENADAHAN PEMBELIAN EMAS DARI HASIL TAMBANG ILEGAL (Studi Putusan Nomor 60/Pid.B/LH/2020/PN Tlk)
Abstract
The impact of mining on the environment is a decrease in land productivity, increased soil density, erosion and sedimentation, the occurrence of soil movements or landslides, disruption of flora and fauna, disruption of public health and impacts on microclimate changes. The problems in this research are 1. Law enforcement against the detention of gold purchases from illegal mining results, the study of decision number 60/Pid.B/LH/2020/PN Tlk. 2. The inhibiting factor for law enforcement against the detention of gold purchases from illegal mining results is the study of decision number 60/Pid.B/LH/2020/PN Tlk. For this writing, the type of research used is Sociological Normative, while the nature of this research is descriptive. Based on the results of research on law enforcement against the detention of gold purchases from illegal mining results, the study of decision number 60/Pid.B/LH/2020/PN Tlk. This begins with the process of transferring the case files from the State Attorney's Office of Singingi. So in this case the process of delegating the case file contains the articles that were charged to the defendant and from these articles it becomes a bright spot for the panel of judges to examine and judge based on procedural law in court. The inhibiting factor in law enforcement against the detention of gold purchases from illegal mining results is the study of case number 60/Pid.B/LH/2020/PN Tlk. This is due to the lack of core witnesses in carrying out gold refining because those who were involved in the gold refining process had already fled, so the only witnesses in this case could be the arresting witnesses or the arresting witnesses, namely the police.
