Abstract

The abuse of narcotics by children is a serious crime that has a significant impact on the future of young generations. In Kuantan Singingi Regency, there was a recorded increase in cases of children as perpetrators of narcotics abuse in 2024, after no similar cases were found from 2021 to 2023. This indicates the need for an evaluation of the implementation of the Juvenile Criminal Justice System (SPPA), particularly at the investigation stage by the police. This study aims to answer two research questions: (1) how is the implementation of SPPA for children as perpetrators of narcotics abuse at the Kuantan Singingi Resort Police?, and (2) what are the obstacles faced in its implementation? This research employs an empirical juridical method with a qualitative approach. Data were collected through interviews with police officers, case document studies, and literature reviews of relevant legislation. The results of the study show that the implementation of SPPA at the Kuantan Singingi Resort Police has generally followed the provisions of Law Number 11 of 2012, including the application of diversion efforts at the investigation stage. However, in practice, several obstacles remain, such as the limited availability of child-friendly facilities, the lack of investigators with special expertise in handling children in conflict with the law, and the negative influence of the social environment on children. Therefore, it can be concluded that although the Kuantan Singingi Resort Police have implemented SPPA in accordance with regulations, improvements are needed in technical aspects, human resource capacity, and inter-agency coordination to optimize legal protection for children.
