TINJAUAN YURIDIS PENEGAKAN HUKUM TERHADAP TINDAK PIDANA PEMBAKARAN LAHAN DI WILAYAH HUKUM KEPOLISIAN SEKTOR KUANTAN MUDIK

Abstract

This research is based on the background  How is Law Enforcement Against Land fires criminal acts in the Kuantan Mudik Sector Police Region  the inhibiting factors of  Law Enforcement of Land fires criminal acts in the Kuantan Mudik Police Region.  This study used a sociological (empirical) method which is one type of legal research that analyzes and examines the workings of the law in the community. Based on the results and analysis of this research, it can be concluded that the handling of law enforcement against land fires in the area of  the Kuantan Mudik Police Sector has  running as it should.  The actions taken by the Kuantan Mudik Sector Police in eradicating the crime of land fires are in the form of preventive (preventive) and repressive (enforcement) actions.  As for preventive measures (prevention) in the form of appeals and directives to the community so as not to burn land throughout the Kuantan Mudik area, because the land must be protected and must be preserved.  whereas the repressive actions taken by the Kuantan Mudik Sector Police include:(1) Investigation (2) Investigation (3) Arrest, (4) Detention (5) prosecution.  As for the inhibiting factors of Law Enforcement by the Kuantan Mudik Sector Police in handling the cases of land fires crimes include: (1) Access Location that is very far from Public Roads, (2) Facilities and infrastuctures (3) Community Factors, and (4)  Lack of Human Resources owned by Law Enforcement Officials.
