PERBANDINGAN ATURAN HUKUM TENTANG TINDAK PIDANA PERDAGANGAN ORANG DI INDONESIA DAN MALAYSIA
Abstract
The Trafficking in Persons 2021 Report places Indonesia in Tier 2 on the issue. The rule of law for trafficking in persons in Indonesia and Malaysia is an interesting legal comparison in the input of national criminal law. This study examines the elements and regulations of trafficking in persons in Indonesia and Malaysia. The findings of this study are: (a) The elements of the Criminal Act of Trafficking in Persons in Malaysia are regulated in the Anti-trafficking Law (UUAPO) Deed 670, while in Indonesia it is regulated in the provisions of Law no. 21 of 2007 concerning the Crime of Trafficking in Persons (UUTPPO). (b) UUTPPO has advantages over the imposition of witnesses which is more decisive than UUAPO Deed 670. In other cases, there is no national regulation regarding the regulation of additional areas, there is no special Council that oversees and carries out the coordinating function to regulate and supervise the implementation of the national action plan and trafficking in persons. also includes support and protection for victims.
